{"id":7003,"date":"2024-10-31T00:45:31","date_gmt":"2024-10-31T00:45:31","guid":{"rendered":"https:\/\/finderica.com\/ftxs-engineering-chief-nishad-singh-spared-prison-time-in-fraud-case\/"},"modified":"2024-10-31T00:45:31","modified_gmt":"2024-10-31T00:45:31","slug":"ftxs-engineering-chief-nishad-singh-spared-prison-time-in-fraud-case","status":"publish","type":"post","link":"https:\/\/finderica.com\/?p=7003","title":{"rendered":"FTX\u2019s engineering chief Nishad Singh spared prison time in fraud case"},"content":{"rendered":"<div>\n<p>Unlock the Editor\u2019s Digest for free<\/p>\n<\/div>\n<div id=\"article-body\">\n<p>The former head of engineering at crypto exchange FTX has been spared a prison sentence after co-operating with prosecutors in the criminal case against founder Sam Bankman-Fried.<\/p>\n<p>Nishad Singh, a 29-year-old coder, was on Wednesday sentenced to supervised release and ordered to forfeit his share of more than $11bn in assets, including a stake in an AI company and a home in the San Juan Islands.<\/p>\n<p>Singh pleaded guilty to fraud and campaign finance violations last year and was a key witness at Bankman-Fried\u2019s trial, in which he told the jury the FTX founder talked to him about a multibillion-dollar hole in customer funds long before the exchange collapsed.\u00a0<\/p>\n<p>Bankman-Fried was subsequently found guilty of fraud and money laundering and sentenced to 25 years in prison.<\/p>\n<p>At a hearing in Manhattan federal court, Judge Lewis Kaplan said he was \u201centirely persuaded\u201d that Singh\u2019s involvement in the FTX fraud was \u201cmuch more limited\u201d than Bankman-Fried\u2019s. He said Singh \u201cdid the right thing\u201d by immediately offering assistance to prosecutors.<\/p>\n<p>Earlier, Singh had told the court he was \u201coverwhelmed with remorse\u201d for his role in FTX\u2019s fraud. Speaking slowly and deliberately, he said he \u201cwanted to be someone who contributes positively to society\u2009.\u2009.\u2009. and is seen as someone who makes earnest efforts to right his wrongs\u201d.<\/p>\n<p>Lawyers for Singh had pleaded for a light sentence on the grounds that he \u201cdid not join the conspiracy at the heart of this case \u2014 the theft of FTX customer funds \u2014 until September 2022, just two months before the collapse of FTX\u201d, according to court filings. <\/p>\n<p>Ahead of his sentencing, Singh also received a letter of support from John Ray III, the restructuring expert who is overseeing FTX\u2019s bankruptcy and has excoriated Bankman-Fried and others at the exchange for their reckless gambling of customer funds.<\/p>\n<p>Ray told the court that Singh had provided \u201cvaluable assistance and co-operation\u201d to the bankruptcy and that his \u201cpersonal involvement in many key events and transactions\u201d meant he would \u201ccontinue to be important to maximise recovery for the creditors\u201d.<\/p>\n<p>The youngest member of the FTX inner circle, Singh left Facebook to join the exchange\u2019s affiliated hedge fund Alameda in late 2017. A close friend of Bankman-Fried\u2019s younger brother, with whom he had attended high school, Singh said at trial that he initially had \u201ca lot of admiration and respect\u201d for the elder Bankman-Fried but that \u201cover time, that eroded\u201d.<\/p>\n<p>He walked the jury through a spreadsheet listing multimillion-dollar sponsorship deals FTX had agreed, including one to rename Miami\u2019s professional basketball arena, and efforts to buy the endorsements of celebrities such as American sport stars Tom Brady and Stephen Curry, alleging that such spending was\u00a0\u201cexcessive\u201d and \u201creeked of\u2009.\u2009.\u2009.\u2009flashiness\u201d.<\/p>\n<p>Last month, Kaplan sentenced Caroline Ellison, the former boss of the trading firm through which FTX gambled billions of dollars in customer funds, to two years in prison, despite a recommendation from prosecutors that she be spared a custodial sentence for her early and fulsome co-operation with the US government and her testimony at trial.<\/p>\n<p>Kaplan acknowledged Ellison was \u201cgenuinely remorseful\u201d, but said her assistance to the government was not a \u201cget out of jail free\u201d card.<\/p>\n<p>A third FTX executive who pleaded guilty and co-operated with prosecutors, Gary Wang, is set to be sentenced later this year.<\/p>\n<div class=\"n-content-video n-content-video--internal\" data-component=\"video\">\n<div class=\"n-content-video__placeholder\" data-o-component=\"o-video\" data-o-video-id=\"f7a7fad1-f3ed-41ee-94a7-e1311989aa7e\"><span>Video: FTX: the legend of Sam Bankman-Fried | FT Film<\/span><\/div>\n<\/div>\n<\/div>\n<p><a href=\"https:\/\/www.ft.com\/content\/e0a29f18-90e7-47e9-bcfc-7ead0ec99f74\" target=\"_blank\" rel=\"noopener\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Unlock the Editor\u2019s Digest for free The former head of engineering at crypto exchange FTX has been spared a prison sentence after co-operating with prosecutors in the criminal case against founder Sam Bankman-Fried.
