We own our home jointly together; does that have any effect on the money owed on his cards if I were to sell the house (or not sell it)?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2014 In Love with a Debtor<\/span><\/p>\n<\/div>\n<p><span style=\"font-weight: 400;\">Dear In Love,<\/span><\/p>\n<p><span style=\"font-weight: 400;\">What happens to your spouse\u2019s\u00a0<\/span><span style=\"font-weight: 400;\">debt after they die<\/span><span style=\"font-weight: 400;\"> depends on a few factors \u2014 but, in most cases, you won\u2019t be held responsible for credit cards that aren\u2019t in your name.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you live in one of nine <\/span><i><span style=\"font-weight: 400;\">community property states<\/span><\/i><span style=\"font-weight: 400;\">, any debt (or assets) your spouse acquires while you\u2019re married are considered joint property. That makes it your responsibility as much as his.\u00a0<\/span><a href=\"https:\/\/www.irs.gov\/irm\/part25\/irm_25-018-001\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Community property states include<\/span><\/a><span style=\"font-weight: 400;\">:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Arizona.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">California.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Idaho.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Louisiana.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">New Mexico.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Nevada.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Texas.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Washington.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Wisconsin.<\/span><\/li>\n<\/ul>\n<p><b>The debt isn\u2019t your responsibility if:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">You live in a state other than those listed above, or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">He acquired the debt before you were married, regardless of where you live.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">In either of those cases, the debt is only in your husband\u2019s name, and his estate will be responsible for repaying it after he dies. So the debt repayment would come out of the estate before any heirs would inherit the rest.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Speak with a lawyer about your home ownership arrangement and your wills to ensure you\u2019ll retain the full equity in case your husband dies. That\u2019s the most likely scenario for a married couple who owns property jointly, but some joint owners have an arrangement that splits the equity and would keep his ownership of the house with his estate.
