But some filers could risk errors on their tax return, experts say.\u00a0<\/p>\n<p>Enacted via Trump&#8217;s &#8220;big beautiful bill,&#8221; the <a href=\"https:\/\/www.irs.gov\/newsroom\/one-big-beautiful-bill-how-to-take-advantage-of-no-tax-on-tips-and-overtime\" target=\"_blank\" rel=\"noopener\">overtime tax break<\/a> allows certain workers to deduct up to $12,500 for single filers or $25,000 for married couples filing jointly per year from 2025 through 2028.<\/p>\n<p>The deduction goes on a new form, known as <a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f1040s1a.pdf\" target=\"_blank\" rel=\"noopener\">Schedule 1-A<\/a>, which feeds into individual tax returns. That schedule also includes Trump&#8217;s new tax breaks for tip income, seniors and auto loan interest.<\/p>\n<p>As of March 4, the IRS received almost 56 million returns, and 43% included Schedule 1-A, Frank Bisignano, Social Security Administration Commissioner and IRS CEO, said this week during a House Ways and Means Committee <a href=\"https:\/\/waysandmeans.house.gov\/event\/full-committee-hearing-with-internal-revenue-service-chief-executive-officer-frank-j-bisignano\/\" target=\"_blank\" rel=\"noopener\">hearing<\/a>. The overtime deduction has been &#8220;the largest filing category&#8221; for that form, he said.<\/p>\n<\/div>\n<div class=\"group\">\n<div class=\"RelatedContent-relatedContent\" id=\"RegularArticle-RelatedContent-1\">\n<div class=\"RelatedContent-container\">\n<div class=\"RelatedContent-nonCollapsibleContent\">\n<h2 class=\"RelatedContent-header\">Read more CNBC personal finance coverage<\/h2>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"group\">\n<p>Trump&#8217;s overtime deduction only applies to a <a href=\"https:\/\/www.irs.gov\/newsroom\/one-big-beautiful-bill-how-to-take-advantage-of-no-tax-on-tips-and-overtime\" target=\"_blank\" rel=\"noopener\">specific type of earnings<\/a>, according to the IRS. <\/p>\n<p>You must have compensation covered under the Fair Labor Standards Act, or FLSA. The law says non-exempt employees must receive at least 1.5 times their normal pay rate once they exceed 40 hours per week. But some workers covered by state or labor contract mandates are excluded. \u00a0\u00a0\u00a0\u00a0<\/p>\n<\/div>\n<div class=\"group\">\n<p>In 2023, roughly 98 million employed workers were eligible for overtime under the FLSA, according to a <a href=\"https:\/\/budgetlab.yale.edu\/news\/240917\/no-tax-overtime-raises-questions-about-policy-design-equity-and-tax-avoidance\" target=\"_blank\" rel=\"noopener\">2024 analysis<\/a> from The Budget Lab at Yale. But only 8% of hourly workers and 4% of salaried workers have FLSA-qualified overtime on a regular basis.<\/p>\n<p>Overtime pay is typically concentrated in sectors like manufacturing, health care, transportation and public safety, according to a <a href=\"https:\/\/www.cato.org\/briefing-paper\/new-income-tax-deductions-tax-free-tips-overtime\" target=\"_blank\" rel=\"noopener\">Feb. 10 report<\/a> from the Cato Institute, a libertarian think tank.\u00a0\u00a0<\/p>\n<\/div>\n<h2 class=\"ArticleBody-subtitle\"><a id=\"headline0\"><\/a>Why your overtime deduction could be wrong<\/h2>\n<div class=\"group\">\n<p>This filing season, it may not be clear to workers how much to claim for the overtime deduction, experts say.<\/p>\n<p>The U.S. Department of the Treasury and IRS in November waived reporting requirements for employers for tax year 2025. That means some workers won&#8217;t see overtime listed on so-called information returns, such as Forms W-2 or 1099.  <\/p>\n<p>Instead, some workers may need payroll statements or their final pay stub from 2025 to calculate overtime totals. But the deduction is only for the &#8220;overtime premium,&#8221; which is the one-half portion if overtime is 1.5 times the normal rate.  <\/p>\n<\/div>\n<blockquote data-test=\"Pullquote\">\n<div class=\"Pullquote-pullquote\" style=\"border-top-color:#002f6c\">\n<div>\n<p>I think there could be a great deal of overstatement of that deduction.<\/p>\n<div class=\"Pullquote-sourceWrapper\">\n<p>Tom O\u2019Saben<\/p>\n<p>Director of tax content and government relations at the National Association of Tax Professionals<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/blockquote>\n<div class=\"group\">\n<p>&#8220;I think there could be a great deal of overstatement of that deduction,&#8221; Tom O&#8217;Saben, director of tax content and government relations at the National Association of Tax Professionals, told CNBC.<\/p>\n<p>If you&#8217;re seeing a lump sum on a payroll statement, you calculate the overtime premium by <a href=\"https:\/\/www.irs.gov\/newsroom\/treasury-irs-provide-guidance-for-individuals-who-received-tips-or-overtime-during-tax-year-2025\" target=\"_blank\" rel=\"noopener\">dividing it by 3<\/a> for 1.5 times your regular pay, or dividing by 4 for 2 times your regular pay, according to the IRS.  <\/p>\n<\/div>\n<div role=\"region\" aria-labelledby=\"Placeholder-ArticleBody-Video-108253301\">\n<div role=\"button\" tabindex=\"0\" id=\"Placeholder-ArticleBody-Video-108253301\" class=\"PlaceHolder-wrapper\" data-vilynx-id=\"7000401017\" data-test=\"VideoPlaceHolder\">\n<div class=\"InlineVideo-videoEmbed\" id=\"InlineVideo-0\" data-test=\"InlineVideo\">\n<div class=\"InlineVideo-wrapper\">\n<div class=\"InlineVideo-inlineThumbnailContainer\"><span class=\"InlineVideo-videoButton\"><\/span><span><\/span><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"group\">\n<p>There&#8217;s no evidence that filers are overclaiming the overtime deduction, &#8220;but it&#8217;s definitely a theoretical concern of mine,&#8221; said Andrew Lautz, director of tax policy for the Bipartisan Policy Center, a nonprofit think tank. &#8220;People just make honest mistakes,&#8221; he said.<\/p>\n<p>Alternatively, if tax forms don&#8217;t show the overtime pay, certain filers could &#8220;take a gamble&#8221; by inflating their earnings, while others with smaller overtime amounts could skip the deduction to avoid issues, Lautz said. <\/p>\n<p>&#8220;Those are all possibilities, given the employer reporting structure is not in place,&#8221; he said. <\/p>\n<\/div>\n<div class=\"ArticleBody-googlePreferredSourceContainer\" data-module=\"GooglePreferredSource\" data-id=\"RegularArticle-GooglePreferredSource-5\">Choose CNBC as your preferred source on Google and never miss a moment from the most trusted name in business news.<\/div>\n<\/div>\n<p><a href=\"https:\/\/www.cnbc.com\/2026\/03\/06\/trump-no-tax-on-overtime.html\" target=\"_blank\" rel=\"noopener\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Pnc | Stockbyte | Getty Images Millions of taxpayers have already filed to claim President Donald Trump&#8217;s new &#8220;no tax on overtime&#8221; deduction.
