David Ake | Getty Images News | Getty Images<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"group\">\n<p>A series of policy changes in the so-called &#8220;big beautiful bill&#8221; are undermining the Affordable Care Act marketplace, in ways that may at first seem relatively subtle but which add up to a major change, health policy experts say. <\/p>\n<p>That, in turn, has important implications for consumers and the broader health care system for years to come, they said.<\/p>\n<p>The law \u2014 a multitrillion-dollar package that the Republican-led Congress passed in July \u2014 contains a series of administrative measures that make it harder or more expensive for many people to sign up for health insurance on the ACA marketplace, experts said. <\/p>\n<p>Those policies concerning the marketplace <a href=\"https:\/\/www.cbo.gov\/publication\/61734\" target=\"_blank\" rel=\"noopener\">would add<\/a> about 3 million people to the ranks of the uninsured over the next decade, the Congressional Budget Office estimated in September. <\/p>\n<p>Among them: ending automatic insurance renewals, removing certain financial protections for lower earners, tweaking annual enrollment periods, and barring many immigrants in the country legally from signing up for ACA marketplace insurance or accessing financial aid. <\/p>\n<\/div>\n<div role=\"region\" aria-labelledby=\"Placeholder-ArticleBody-Video-108266794\">\n<div role=\"button\" tabindex=\"0\" id=\"Placeholder-ArticleBody-Video-108266794\" class=\"PlaceHolder-wrapper\" data-vilynx-id=\"7000404151\" data-test=\"VideoPlaceHolder\">\n<div class=\"InlineVideo-videoEmbed\" id=\"InlineVideo-0\" data-test=\"InlineVideo\">\n<div class=\"InlineVideo-wrapper\">\n<div class=\"InlineVideo-inlineThumbnailContainer\"><span class=\"InlineVideo-videoButton\"><\/span><span><\/span><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"group\">\n<p>However, the administrative maneuvers \u2014 many of which are technical in nature and, on their face, may not seem consequential \u2014 have largely gone unnoticed by the public, experts said. <\/p>\n<p>&#8220;A lot of things that are happening are kind of under the radar,&#8221; said Jonathan Oberlander, a professor at the University of North Carolina and an expert in health-care politics and policy. &#8220;I&#8217;d describe the strategy as one of partial stealth,&#8221; he said. <\/p>\n<p>Other parts of the law \u2014 like more than $1 trillion<strong> <\/strong>of cuts to Medicaid, the public health program for lower earners \u2014 have garnered the bulk of public attention, experts said. <\/p>\n<\/div>\n<div class=\"group\">\n<div class=\"RelatedContent-relatedContent\" id=\"RegularArticle-RelatedContent-1\">\n<div class=\"RelatedContent-container\">\n<div class=\"RelatedContent-nonCollapsibleContent\">\n<h2 class=\"RelatedContent-header\">Read more CNBC personal finance coverage<\/h2>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<h2 class=\"ArticleBody-subtitle\"><a id=\"headline0\"><\/a>Largest rollback of health insurance coverage<\/h2>\n<div class=\"group\">\n<p>The Affordable Care Act, also known as Obamacare, established a health insurance marketplace where Americans could shop for private health plans. <\/p>\n<p>The law, passed in 2010, also created premium tax credits and other assistance to make coverage more affordable for certain enrollees, and expanded access to Medicaid. <\/p>\n<p>ACA marketplace enrollees are often small business owners, gig workers, freelancers and others who can&#8217;t get health insurance elsewhere, such as via Medicaid, Medicare or coverage through an employer. <\/p>\n<p>Obamacare helped drive down the U.S. uninsured rate to <a href=\"https:\/\/www.kff.org\/uninsured\/health-policy-101-the-uninsured-population-and-health-coverage\/?entry=table-of-contents-introduction\" target=\"_blank\" rel=\"noopener\">record lows<\/a> in recent years, experts said. <\/p>\n<\/div>\n<div role=\"region\" aria-labelledby=\"Placeholder-ArticleBody-Video-108247574\">\n<div role=\"button\" tabindex=\"0\" id=\"Placeholder-ArticleBody-Video-108247574\" class=\"PlaceHolder-wrapper\" data-vilynx-id=\"7000399747\" data-test=\"VideoPlaceHolder\">\n<div class=\"InlineVideo-videoEmbed\" id=\"InlineVideo-0\" data-test=\"InlineVideo\">\n<div class=\"InlineVideo-wrapper\">\n<div class=\"InlineVideo-inlineThumbnailContainer\"><img decoding=\"async\" class=\"InlineVideo-videoThumbnail\" src=\"https:\/\/image.cnbcfm.com\/api\/v1\/image\/108247575-17673740321767374029-43295054705-1080pnbcnews.jpg?v=1767374031&amp;w=750&amp;h=422&amp;vtcrop=y\" alt=\"Dr. Vin Gupta on how the expiration of enhanced ACA subsidies will affect Americans\"><span class=\"InlineVideo-videoButton\"><\/span><span><\/span><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"group\">\n<p>However, health provisions in the &#8220;big beautiful bill&#8221; amount to the largest rollback of health insurance coverage in U.S. history, Oberlander said.<\/p>\n<p>The share of the U.S. population without health insurance <a href=\"https:\/\/www.cbo.gov\/system\/files\/2026-02\/51298-2026-02-healthinsurance.pdf\" target=\"_blank\" rel=\"noopener\">is expected to swell from 7.6% in 2025 to 10.4%<\/a> by the end of the decade, according to the CBO. <\/p>\n<p>Total enrollment in ACA marketplace health plans <a href=\"https:\/\/www.cbo.gov\/system\/files\/2026-02\/51298-2026-02-healthinsurance.pdf\" target=\"_blank\" rel=\"noopener\">is expected to fall to 12.5 million by 2028<\/a>, the CBO estimated in February. That would be about half of <a href=\"https:\/\/www.kff.org\/affordable-care-act\/state-indicator\/marketplace-enrollment\/?activeTab=graph&amp;amp;currentTimeframe=0&amp;amp;startTimeframe=11&amp;amp;sortModel=%7B%22colId%22:%22Location%22,%22sort%22:%22asc%22%7D\" target=\"_blank\" rel=\"noopener\">last year&#8217;s enrollment<\/a> and represent a near-erasure of all gains in marketplace sign-ups since 2021, when the enhanced subsidies took effect.  <\/p>\n<\/div>\n<div class=\"group\">\n<p>There are many potential downstream effects of this dynamic, according to health experts.<\/p>\n<p>Millions of Americans becoming uninsured pose a serious financial risk to affected households, they said. Millions more will shift to plans with higher deductibles, reducing upfront premiums but leaving them exposed to big medical bills if they need to use their insurance. <\/p>\n<\/div>\n<blockquote data-test=\"Pullquote\">\n<div class=\"Pullquote-pullquote\" style=\"border-top-color:#002f6c\">\n<div>\n<p>I&#8217;d describe the strategy as one of partial stealth.<\/p>\n<div class=\"Pullquote-sourceWrapper\">\n<p>Jonathan Oberlander<\/p>\n<p>professor at the University of North Carolina<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/blockquote>\n<div class=\"group\">\n<p>There are also implications for the health care system at large. Hospitals with higher uninsured populations would likely face financial pressures, in turn impacting everyone who goes to the hospital by reducing resources available to treat people, Oberlander said.<\/p>\n<p>&#8220;When individuals lose health insurance coverage, they ultimately turn to their local hospital when they need care,&#8221; the American Hospital Association <a href=\"https:\/\/www.aha.org\/system\/files\/media\/file\/2025\/06\/Fact-Sheet-One-Big-Beautiful-Bill-Act-Would-Significantly-Reduce-Availability-of-Coverage.pdf\" target=\"_blank\" rel=\"noopener\">wrote<\/a> in June. &#8220;This affects everyone, not only the uninsured, leading to overcrowded emergency departments, longer wait times and increased costs for care, which acts as a &#8216;hidden tax&#8217; on all.&#8221;<\/p>\n<\/div>\n<h2 class=\"ArticleBody-subtitle\"><a id=\"headline1\"><\/a>&#8216;Repeal and replace,&#8217; by a different name <\/h2>\n<div class=\"InlineImage-imageEmbed\" id=\"ArticleBody-InlineImage-108242135\" data-test=\"InlineImage\">\n<div class=\"InlineImage-wrapper\">\n<div>\n<p>The late Sen. McCain was one of three Republican Senators to vote against the measure. <\/p>\n<p>Zach Gibson | Getty Images News | Getty Images<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"group\">\n<p>Republicans have tried to dismantle the Affordable Care Act for years, partly due to ideological differences in health policy and increased partisan polarization, experts said. <\/p>\n<p>Indeed, the ACA was passed into law in 2010 without a single Republican vote.<\/p>\n<p>Health policy experts said the administrative policies in the &#8220;big beautiful bill&#8221; that aim to cripple the ACA amount to a less flashy version of &#8220;repeal and replace.&#8221; <\/p>\n<p>The term refers to previous Republican efforts to scrap large parts of the ACA and replace it with something new. <\/p>\n<\/div>\n<div class=\"group\">\n<p>The GOP came close to fulfilling that goal during President Donald Trump&#8217;s first term in office. However, the late Republican Sen. John McCain of Arizona cast a decisive thumbs-down vote in the Senate in 2017, scuttling legislation to repeal the health law. <\/p>\n<p>President Trump has often said he dislikes the Affordable Care Act. <\/p>\n<p>&#8220;The best thing we can do, politically speaking, is let Obamacare explode,&#8221; he <a href=\"https:\/\/www.npr.org\/2017\/03\/27\/521441490\/fact-check-trump-says-obamacare-is-exploding-its-not\" target=\"_blank\" rel=\"noopener\">said<\/a> in the White House in March 2017. &#8220;We&#8217;ll end up with a truly great health care bill in the future after this mess known as Obamacare explodes,&#8221; he <a href=\"https:\/\/time.com\/4713107\/donald-trump-transcript-ahca-bill\/\" target=\"_blank\" rel=\"noopener\">added<\/a>. <\/p>\n<p>In October 2017, a few months after the effort to repeal the ACA failed in the Senate, he <a href=\"https:\/\/x.com\/realDonaldTrump\/status\/918797009133465600\" target=\"_blank\">wrote<\/a> on social media site X that &#8220;ObamaCare is a broken mess.&#8221; <\/p>\n<p>&#8220;Piece by piece we will now begin the process of giving America the great HealthCare it deserves!&#8221; he wrote.<\/p>\n<p>Trump and congressional Republicans have said the ACA has contributed to rising costs for health care, such as insurance premiums. There is some <a href=\"https:\/\/econofact.org\/factbrief\/fact-check-have-healthcare-costs-risen-faster-since-the-affordable-care-act-was-passed\" target=\"_blank\" rel=\"noopener\">debate<\/a> on this point, though, and some experts point to other contributors to rising costs, such as consolidation among health care providers and physician billing practices.<\/p>\n<\/div>\n<div class=\"group\">\n<p>Policies in the &#8220;big beautiful bill&#8221; \u2014 including cuts to Medicaid \u2014 and the expiration of enhanced premium tax credits will lead about 15 million people to lose health insurance, the CBO <a href=\"https:\/\/www.cbo.gov\/system\/files\/2025-06\/Wyden-Pallone-Neal_Letter_6-4-25.pdf\" target=\"_blank\" rel=\"noopener\">estimated in June<\/a> when scoring the impact of the legislation.<\/p>\n<p>&#8220;[That&#8217;s] not far outside the scope of what some of the repeal-and-replace plans from 2017 would have done,&#8221; said Cynthia Cox, director of the Affordable Care Act program at KFF, a nonpartisan health policy research group. <\/p>\n<p>Separately, new rules proposed by the Trump administration in February would further decrease ACA marketplace enrollment by up to 2 million people in 2027, <a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/02\/11\/2026-02769\/patient-protection-and-affordable-care-act-hhs-notice-of-benefit-and-payment-parameters-for-2027-and\" target=\"_blank\" rel=\"noopener\">the U.S. Department for Health and Human Service estimated<\/a>. <\/p>\n<p>If adopted, the rules would, <a href=\"https:\/\/www.healthaffairs.org\/content\/forefront\/hhs-proposes-sweeping-changes-2027-marketplace-plans-part-1\" target=\"_blank\" rel=\"noopener\">among other things<\/a>, expand access to so-called catastrophic plans with even higher out-of-pocket costs, defray certain state-mandated benefits and add &#8220;burdensome&#8221; verification requirements for enrollees, according to Katie Keith, director of the Center for Health Policy and the Law at Georgetown University Law Center&#8217;s O&#8217;Neill Institute.<\/p>\n<\/div>\n<h2 class=\"ArticleBody-subtitle\"><a id=\"headline2\"><\/a>Most Americans like ACA, making repeal difficult<\/h2>\n<div class=\"group\">\n<p>In general, Republicans and Democrats fundamentally disagree on the role of government in health care policy. <\/p>\n<p>Democrats believe the government should be active and take steps toward giving all Americans access to health insurance, while Republicans tend to favor a more limited government role and view universal coverage as not a priority, experts said. <\/p>\n<p>GOP rancor toward the ACA is also fueled in part by partisan hostility, Oberlander said. Resisting Democrats and the expansion of the federal government has become a rallying cry for the party, he said. <\/p>\n<\/div>\n<div role=\"region\" aria-labelledby=\"Placeholder-ArticleBody-Video-108241737\">\n<div role=\"button\" tabindex=\"0\" id=\"Placeholder-ArticleBody-Video-108241737\" class=\"PlaceHolder-wrapper\" data-vilynx-id=\"7000398330\" data-test=\"VideoPlaceHolder\">\n<div class=\"InlineVideo-videoEmbed\" id=\"InlineVideo-0\" data-test=\"InlineVideo\">\n<div class=\"InlineVideo-wrapper\">\n<div class=\"InlineVideo-inlineThumbnailContainer\"><img decoding=\"async\" class=\"InlineVideo-videoThumbnail\" src=\"https:\/\/image.cnbcfm.com\/api\/v1\/image\/108241738-17658020071765802003-42996395672-1080pnbcnews.jpg?v=1765802006&amp;w=750&amp;h=422&amp;vtcrop=y\" alt=\"Sen. Pete Ricketts on health care: Republicans want to empower people by giving them the money\"><span class=\"InlineVideo-videoButton\"><\/span><span><\/span><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"group\">\n<p>However, Obamacare popularity has increased gradually since its inception. <\/p>\n<p>Now, most Americans \u2014 58% \u2014 <a href=\"https:\/\/www.kff.org\/affordable-care-act\/the-publics-views-on-the-aca-tracker\/#a6bdcf41-1f3d-4c3a-b827-91df51fffaa9\" target=\"_blank\" rel=\"noopener\">have a favorable view of the law<\/a>, according to KFF, which has tracked public opinion since 2010. Ironically, public opinion started to shift in the ACA&#8217;s favor after repeal-and-replace measures failed in Congress around 2017, said KFF&#8217;s Cox. <\/p>\n<p>Current popularity makes it more politically challenging to repeal the law outright, experts said. <\/p>\n<\/div>\n<div class=\"InlineImage-imageEmbed\" id=\"ArticleBody-InlineImage-108273706\" data-test=\"InlineImage\">\n<div class=\"InlineImage-wrapper\">\n<div>\n<p>Rep. Johnson will block a push by moderate House Republicans for a vote on renewing expiring Obamacare subsidies, quashing a last-ditch effort to head off a spike in insurance premiums.<\/p>\n<p>Bloomberg | Bloomberg | Getty Images<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"group\">\n<p>The GOP&#8217;s political calculus appears to be that by making Obamacare work less efficiently, Americans will become frustrated with the law, giving lawmakers political cover to eventually replace it, said Casey Burgat, director of the legislative affairs program at The George Washington University&#8217;s Graduate School of Political Management.<\/p>\n<p>&#8220;Most of it has to do with making things harder administratively,&#8221; Burgat said. &#8220;The nerds call it administrative attrition.&#8221;<\/p>\n<p>And, many people won&#8217;t know it was the GOP who made it harder, he said. <\/p>\n<p>It&#8217;s a similar dynamic to certain voter registration rules, he said: Adding more administrative hurdles pushes people off the voter registration rolls, Burgat said. <\/p>\n<\/div>\n<h2 class=\"ArticleBody-subtitle\"><a id=\"headline3\"><\/a>ACA policies in the big beautiful bill<\/h2>\n<div class=\"InlineImage-imageEmbed\" id=\"ArticleBody-InlineImage-108225117\" data-test=\"InlineImage\">\n<div class=\"InlineImage-wrapper\">\n<div>\n<p>An Obamacare sign at a Miami insurance agency on Nov. 12, 2025.<\/p>\n<p>Joe Raedle | Getty Images<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"group\">\n<p>Republicans also said some of the <a href=\"https:\/\/www.congress.gov\/crs-product\/R48569\" target=\"_blank\" rel=\"noopener\">policy changes<\/a> in the &#8220;big beautiful bill&#8221; are due to concerns about waste, fraud and abuse. <\/p>\n<p>The Paragon Health Institute, a conservative health policy think tank, <a href=\"https:\/\/paragoninstitute.org\/medicaid\/health-care-provisions-in-the-one-big-beautiful-bill-reducing-waste-fraud-and-abuse-while-empowering-american-patients\/?nab=0\" target=\"_blank\" rel=\"noopener\">in May wrote <\/a>that<a href=\"https:\/\/paragoninstitute.org\/medicaid\/health-care-provisions-in-the-one-big-beautiful-bill-reducing-waste-fraud-and-abuse-while-empowering-american-patients\/?nab=0\" target=\"_blank\" rel=\"noopener\"> <\/a>the measures were &#8220;commonsense program integrity provisions&#8221; to reduce fraud and spending, and said they would cut back on the &#8220;Biden administration&#8217;s approach of maximizing enrollment at any cost.&#8221;<\/p>\n<p>Some health experts have said that, while there has been evidence of fraud, the concerns have been exaggerated. <\/p>\n<p>&#8220;Fraud should be addressed,&#8221; said Cox of KFF. &#8220;But this [law] doesn&#8217;t just address fraud. It also makes it more difficult for 20 million-some [ACA enrollees] to keep it from year to year.&#8221;<\/p>\n<p>Here are some of the significant changes, according to experts.<\/p>\n<h3 class=\"ArticleBody-smallSubtitle\">Prohibits auto-renewal<\/h3>\n<p>Among the more consequential changes is the <a href=\"https:\/\/www.kff.org\/medicaid\/health-provisions-in-the-2025-federal-budget-reconciliation-law\/#11b14007-9dd9-4b35-8c5a-31fb55714cc9\" target=\"_blank\" rel=\"noopener\">effective end of automatic re-enrollment<\/a> into one&#8217;s existing ACA marketplace health insurance plan, due to the addition of certain verification requirements \u2014 around factors like household income, place of residence and family size \u2014 before enrolling, Cox said.<\/p>\n<p>Previously, households with existing coverage who didn&#8217;t act during open enrollment were auto-renewed into the same plan or a similar one for the coming year. Nearly half of enrollees auto-renewed in 2025, according to KFF.<\/p>\n<h3 class=\"ArticleBody-smallSubtitle\">Excess subsidies must be repaid in full<\/h3>\n<p>The bill would eliminate repayment caps for premium subsidies, known as premium tax credits. <\/p>\n<p>Most households that receive these federal tax credits opt to get them ahead of tax season. Households estimate their annual income for the coming year, which dictates their total premium tax credit. They must repay excess subsidies during tax season, if their annual income ends up being larger than they&#8217;d initially estimated.\u00a0<\/p>\n<p>Previously, there was a cap on how much money certain households would have to repay, on a sliding scale based on income, in order to avoid a financial shock during tax season. <\/p>\n<p>Now, all excess subsidies will have to be repaid in full, no matter a household&#8217;s income.<\/p>\n<p>This provision took effect for tax year 2026, meaning people will experience it when they file their taxes in 2027.<\/p>\n<h3 class=\"ArticleBody-smallSubtitle\">Changes to enrollment periods<\/h3>\n<\/div>\n<div class=\"InlineImage-imageEmbed\" id=\"ArticleBody-InlineImage-108220642\" data-test=\"InlineImage\">\n<div class=\"InlineImage-wrapper\">\n<div>\n<p>The healthcare.gov website on a laptop arranged in Norfolk, Virginia, US, on Saturday, Nov. 1, 2025. <\/p>\n<p>Stefani Reynolds | Bloomberg | Getty Images<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"group\">\n<p>The law shortens the annual enrollment period for ACA marketplace coverage. <\/p>\n<p>Previously, enrollment ran from Nov. 1 to Jan. 15. That enrollment window ends Dec. 15 \u2014 or, one month earlier \u2014 in all states.
