{"id":19777,"date":"2025-08-22T21:01:47","date_gmt":"2025-08-22T21:01:47","guid":{"rendered":"https:\/\/finderica.com\/?p=19777"},"modified":"2025-08-22T21:01:47","modified_gmt":"2025-08-22T21:01:47","slug":"student-loan-borrowers-in-default-face-wage-garnishment","status":"publish","type":"post","link":"https:\/\/finderica.com\/?p=19777","title":{"rendered":"Student loan borrowers in default face wage garnishment"},"content":{"rendered":"<div id=\"RegularArticle-ArticleBody-5\" data-module=\"ArticleBody\" data-test=\"articleBody-2\" data-analytics=\"RegularArticle-articleBody-5-2\"><span class=\"HighlightShare-hidden\" style=\"top:0;left:0\"><\/span><\/p>\n<div class=\"InlineImage-imageEmbed\" id=\"ArticleBody-InlineImage-107377170\" data-test=\"InlineImage\">\n<div class=\"InlineImage-wrapper\">\n<div>\n<p>A student studies in the Perry-Castaneda Library at the University of Texas at Austin on February 22, 2024 in Austin, Texas.\u00a0<\/p>\n<p>Brandon Bell | Getty Images<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"group\">\n<p>When the Trump administration first announced in <a href=\"https:\/\/www.ed.gov\/about\/news\/press-release\/us-department-of-education-begin-federal-student-loan-collections-other-actions-help-borrowers-get-back-repayment\" target=\"_blank\" rel=\"noopener\">April<\/a> that it would soon resume student loan collection efforts, it said notices for wage garnishment would resume &#8220;later this summer.&#8221; It&#8217;s still a time frame the Education Department has cited in comments, as recently as earlier this month.<\/p>\n<p>But with Labor Day coming up, it has yet to reveal a specific date.<\/p>\n<p>The department did not respond to a request for comment on the timeline of wage garnishments.<\/p>\n<p>&#8220;Getting these programs set back up takes time,&#8221; said Scott Buchanan, executive director of the Student Loan Servicing Alliance, a trade group for federal student loan servicers. &#8220;I would expect at least a month or more&#8221; before garnishment begins, he said.<\/p>\n<p><strong>More from Personal Finance:<\/strong><br \/>Trump floats tariff &#8216;rebate&#8217; for consumers<br \/>Student loan forgiveness may soon be taxed again<br \/>Student loan borrowers \u2014 how will the end of the SAVE plan impact you? Tell us<\/p>\n<p>Collection activity on\u00a0federal student loans\u00a0has been mostly paused for around five years, since the start of the Covid pandemic in 2020. It&#8217;s a significant change for borrowers to have their paychecks at risk again, consumer advocates say.<\/p>\n<p>As of a May announcement, more than <a href=\"https:\/\/www.ed.gov\/about\/news\/press-release\/us-department-of-education-reminds-colleges-and-universities-of-their-obligations-help-struggling-borrowers\" target=\"_blank\" rel=\"noopener\">5.3 million student loan borrowers<\/a> are in default.<\/p>\n<p>&#8220;I would strongly advise borrowers to not wait to take action until wage garnishment begins,&#8221; Buchanan said.<\/p>\n<p>Here&#8217;s what to know about protecting your wages if you&#8217;re behind on your student loans.<\/p>\n<\/div>\n<h2 class=\"ArticleBody-subtitle\"><a id=\"headline0\"><\/a>Federal government can take up to 15%<\/h2>\n<div class=\"group\">\n<p>The U.S. Department of Education can garnish up to 15% of your disposable, or after-tax, pay, said higher education expert Mark Kantrowitz.<\/p>\n<p>By law, you must be left with at least 30 times the federal\u00a0minimum hourly wage ($7.25) a week, which is $217.50, Kantrowitz said.<\/p>\n<p>It is more difficult for the\u00a0federal government to garnish the wages of someone who receives 1099 income, Kantrowitz said.<\/p>\n<p>&#8220;If there is no employer, wage garnishment can&#8217;t happen,&#8221; he said.<\/p>\n<\/div>\n<h2 class=\"ArticleBody-subtitle\"><a id=\"headline1\"><\/a>You can challenge the garnishment<\/h2>\n<div class=\"group\">\n<p>Borrowers in default should receive a 30-day notice before their wages are garnished, experts said.<\/p>\n<p>During that period, you should have the option to have a hearing before an administrative law judge, Kantrowitz said. The Education Department notice is supposed to include information on how you request that, he said.<\/p>\n<p>Your wages may be protected if you&#8217;ve recently been unemployed or filed for bankruptcy, Kantrowitz said.<\/p>\n<p>Borrowers can also challenge the wage garnishment if it will result in\u00a0<a href=\"https:\/\/www.ecfr.gov\/current\/title-34\/subtitle-A\/part-34\" target=\"_blank\" rel=\"noopener\">financial hardship<\/a>, he added.<\/p>\n<\/div>\n<h2 class=\"ArticleBody-subtitle\"><a id=\"headline2\"><\/a>Your employer can&#8217;t terminate you<\/h2>\n<div class=\"group\">\n<p>Most employers will already be familiar with the wage garnishment process, Kantrowitz said.
