(Photo by <span class=\"plus\" data-ga-track=\"caption expand\">&#8230; More<\/span><span class=\"expanded-caption\"> Scott Eisen\/Getty Images)<\/span><\/p>\n<p><\/fbs-accordion><small>Getty Images<\/small><\/figcaption><\/figure>\n<p>President Donald Trump\u2019s multiple threats to revoke the tax-exempt status of organizations that disagree with him have deeply troubling implications for the credibility of the federal revenue system and for democracy broadly.<\/p>\n<p>His highest profile threat was his request that the <a href=\"https:\/\/www.cnn.com\/2025\/04\/16\/politics\/irs-harvard-tax-exempt-status\/index.html\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.cnn.com\/2025\/04\/16\/politics\/irs-harvard-tax-exempt-status\/index.html\" aria-label=\"IRS revoke Harvard University\u2019s tax-exempt status\">IRS revoke Harvard University\u2019s tax-exempt status<\/a>. But Harvard wasn\u2019t the president\u2019s only target. <a href=\"https:\/\/www.politico.com\/news\/2025\/04\/17\/harvards-a-disgrace-trump-eyes-targeting-more-tax-exempt-orgs-00298039\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.politico.com\/news\/2025\/04\/17\/harvards-a-disgrace-trump-eyes-targeting-more-tax-exempt-orgs-00298039\" aria-label=\"On April 17, he told reporters\">On April 17, he told reporters<\/a>, \u201cWe\u2019re looking at\u201d a nonprofit group called <a href=\"https:\/\/www.citizensforethics.org\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.citizensforethics.org\/\" aria-label=\"Citizens for Responsibility and Ethics in Washington\">Citizens for Responsibility and Ethics in Washington <\/a>that has filed several lawsuits against his Administration.<\/p>\n<p><a href=\"https:\/\/www.youtube.com\/watch?v=iq7I6LQup2c\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.youtube.com\/watch?v=iq7I6LQup2c\" aria-label=\"And he separately warned\">And he separately warned<\/a> that \u201cTax exempt status is a privilege, it\u2019s really a privilege, and it\u2019s been abused by a lot more than Harvard.\u201d<\/p>\n<p>I\u2019ve written for years at The Tax Policy Center and on Forbes.com about the many problems with the way organizations use, and abuse, tax-exempt status. Big-time college <a href=\"https:\/\/taxpolicycenter.org\/taxvox\/why-are-big-time-college-sports-revenues-exempt-income-tax\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/taxpolicycenter.org\/taxvox\/why-are-big-time-college-sports-revenues-exempt-income-tax\" aria-label=\"athletic departments avoid tax\">athletic departments avoid tax<\/a> on football and basketball profits. Major donors use certain tax-exempt organizations as a tool to hide millions of dollars in campaign contributions.<\/p>\n<p>Tax-exempt status needs rethinking. But tax exemption is not a privilege to be given or taken by a president seeking to reward friends or punish perceived enemies.<\/p>\n<h2>The Backstory<\/h2>\n<p><a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/26\/7217\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.law.cornell.edu\/uscode\/text\/26\/7217\" aria-label=\"It is a crime for the president or other top level administration officials to ask\">It is a crime for the president or other top level administration officials to ask <\/a>the IRS to act against specific taxpayers. And even the appearance of political pressure can taint a case. In 1973<a href=\"https:\/\/law.justia.com\/cases\/federal\/district-courts\/FSupp\/368\/863\/1802467\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/law.justia.com\/cases\/federal\/district-courts\/FSupp\/368\/863\/1802467\/\" aria-label=\", a federal district court blocked an IRS effort to revoke an organization\u2019s tax-exempt\">, a federal district court blocked an IRS effort to revoke an organization\u2019s tax-exempt<\/a> status merely because there was a \u201ccreation of a political atmosphere generated by the White House in the Internal Revenue Service.&#8221;<\/p>\n<p>Yet, revoking tax-exempt status could have a profound financial impact on an organization, even if it ultimately is reversed by the courts. While the dispute dragged on, donors would be at best uncertain about whether they could deduct any charitable gifts.<\/p>\n<p>The administration move has an important backstory. A decade ago, the IRS set off a firestorm with a clumsy attempt to end the tax-exempt status of many political advocacy groups. Conservatives claimed the effort targeted only conservative groups,  though an independent review found organizations across the political spectrum were targeted and few ever were denied tax-exempt status.<\/p>\n<p>But there was another crucial difference between that episode and today: The 2011 effort was generated by mid-level IRS staffers, not by the president of the United States.<\/p>\n<h2>Three Disputes<\/h2>\n<p>Trump seems to have three disputes with Harvard: He alleges it encouraged diversity, equity, and inclusion in hiring, admissions, and curricula; It was slow to halt anti-Israel protests that morphed into what many saw as anti-Semitism; and it <a href=\"https:\/\/apnews.com\/article\/harvard-trump-administration-federal-cuts-antisemitism-0a1fb70a2c1055bda7c4c5a5c476e18d\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/apnews.com\/article\/harvard-trump-administration-federal-cuts-antisemitism-0a1fb70a2c1055bda7c4c5a5c476e18d\" aria-label=\"rejected White House demands\">rejected White House demands<\/a> that the Trump administration oversee specific changes in the university\u2019s academics and governance.<\/p>\n<p>The move to revoke Harvard\u2019s tax-exemption is part of a broader campaign against the school that includes ending $2.2 billion in government funding and its ability to enroll foreign students. Harvard has responded by suing the administration.<\/p>\n<h2>A Legal Reach<\/h2>\n<p>If the IRS does try to revoke Harvard\u2019s tax-exempt status, it could rely on two issues: that Harvard\u2019s DEI initiatives <a href=\"https:\/\/www.winston.com\/en\/insights-news\/harvard-universitys-tax-exempt-status-challenged-what-nonprofits-need-to-know\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.winston.com\/en\/insights-news\/harvard-universitys-tax-exempt-status-challenged-what-nonprofits-need-to-know\" aria-label=\"violate public policy or that it illegally engaged in political activity.\">violate public policy or that it illegally engaged in political activity.<\/a><\/p>\n<p><a href=\"https:\/\/www.irs.gov\/charities-non-profits\/charitable-organizations\/exemption-requirements-501c3-organizations\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.irs.gov\/charities-non-profits\/charitable-organizations\/exemption-requirements-501c3-organizations\" aria-label=\"Harvard is a 501(c)(3) charitable organization\">Harvard is a 501(c)(3) charitable organization<\/a> whose activities are constrained. Yet, experts in tax-exempt law say both potential allegations would be a reach.<\/p>\n<p>The public policy argument could rely on a <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/461\/574.html\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/461\/574.html\" aria-label=\"1983 Supreme Court decision involving Bob Jones University.\">1983 Supreme Court decision involving Bob Jones University.<\/a> In that case, the IRS revoked the school\u2019s tax-exempt status because it discriminated against Black applicants.<\/p>\n<p>That violated established federal laws against racial discrimination. The Supreme Court\u2019s 8-1 opinion said, &#8220;Government has a fundamental, overriding interest in eradicating racial discrimination in education.\u201d The opinion noted that more than two decades of legislation, court rulings, and regulation all aimed to achieve that goal.<\/p>\n<p>In contrast, while Harvard may not share Trump\u2019s views on DEI, it would be hard for the IRS to make the case that its policies violate settled policy. \u201cI don&#8217;t see how a position regarding DEI adopted since Trump&#8217;s inauguration can establish a fundamental public policy,\u201d Ellen Aprill, Senior Scholar in Residence at the Lowell Milken Center for Philanthropy and Nonprofits and Professor Emerita at Loyola Law School, told me.<\/p>\n<p>The claim that Harvard\u2019s hiring and admissions policies and its response to campus protests amount to illegal political activity seems like <a href=\"https:\/\/digitalcommons.lmu.edu\/llr\/vol56\/iss4\/6\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/digitalcommons.lmu.edu\/llr\/vol56\/iss4\/6\/\" aria-label=\"even more of a stretch\">even more of a stretch<\/a>.<\/p>\n<p>A case against CREW, also a 501(c)(3), raises different questions since it heavily engages in what seems like advocacy, though not prohibited lobbying or partisan political activity. But so do hundreds or even thousands of similar tax-exempts, whose activities are <a href=\"https:\/\/taxpolicycenter.org\/taxvox\/could-congress-actually-crack-down-tax-exempt-political-organizations\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/taxpolicycenter.org\/taxvox\/could-congress-actually-crack-down-tax-exempt-political-organizations\" aria-label=\"largely unaddressed by an understaffed IRS\">largely unaddressed by an understaffed IRS<\/a>.<\/p>\n<p>It might take years for the IRS to resolve these claims: The Bob Jones case dragged on for more than a decade. <a href=\"https:\/\/www.tenenbaumlegal.com\/nonprofits-under-fire-how-the-irs-can-and-cannot-revoke-federal-tax-exempt-status\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.tenenbaumlegal.com\/nonprofits-under-fire-how-the-irs-can-and-cannot-revoke-federal-tax-exempt-status\/\" aria-label=\"In the normal course of events\">In the normal course of events<\/a>, the IRS first would formally explain why it intended to revoke tax-exempt status, the organization would respond, and the agency would give the group the opportunity to settle, perhaps by remediating any impermissible activity. The tax-exempt could then appeal any decision in court.<\/p>\n<p>But beyond any administrative challenges, Trump\u2019s threats raise a far more profound question: Is tax-exempt status a favor to be doled out by a president to groups that agree with him, and taken from groups that do not?<\/p>\n<\/div>\n<p><a href=\"https:\/\/www.forbes.com\/sites\/howardgleckman\/2025\/04\/25\/why-trumps-efforts-to-revoke-tax-exemptions-are-so-dangerous\/\" target=\"_blank\" rel=\"noopener\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>CAMBRIDGE, MASSACHUSETTS &#8211; APRIL 15: Tourists in front of the main gate to Harvard Yard.
